本利用規約（以下「本規約」）は、DAIKI HAYASHI（以下「開発者」）が提供するiOSアプリケーション「Zukanly」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたは使用することにより、本規約に同意したものとみなされます。

1. ライセンスの付与

開発者は、本規約に従い、お客様に対して本アプリを個人的かつ非商用で使用するための、限定的・非独占的・譲渡不能なライセンスを付与します。本ライセンスには以下の制限が含まれます：

• 本アプリの複製、改変、リバースエンジニアリング、逆コンパイル、逆アセンブルを行わないこと
• 本アプリの全部または一部を販売、貸与、リース、再配布しないこと
• 本アプリを違法な目的で使用しないこと

2. サービスの内容

本アプリは、自然観察の記録・管理を目的とした図鑑アプリです。主に以下の機能を提供します：

• 写真による生物の登録・管理
• AIによる種の自動判定（判定結果は参考情報であり、正確性を保証するものではありません）
• AIによる図鑑ページの自動生成
• マップ上での発見場所の記録

3. AI機能に関する免責事項

本アプリのAI判定機能は、写真から生物の種を推定する参考ツールです。以下の点にご留意ください：

• AI判定の結果は参考情報であり、学術的・医学的な正確性を保証するものではありません
• 有毒・危険な生物の判別にAI判定のみを用いることは避けてください
• 食用可否の判断にAI判定の結果を使用しないでください
• AI判定の結果に基づく行動はすべてお客様の責任となります

4. サブスクリプション

• 本アプリは無料で基本機能を提供し、追加機能を含むProプラン（月額/年額の自動更新サブスクリプション）を提供します
• サブスクリプションはApple IDアカウントに対して課金されます
• 無料トライアル期間がある場合、未使用分はサブスクリプション購入時に失効します
• 現在の期間終了の少なくとも24時間前までにキャンセルしない限り、自動的に更新されます
• サブスクリプションの管理およびキャンセルは、購入後にApp Storeのアカウント設定から行えます
• サブスクリプション期間中の途中キャンセルによる日割り返金は行いません

5. ユーザーコンテンツ

• お客様が本アプリに登録した写真、メモ、その他のコンテンツの知的財産権はお客様に帰属します
• AI判定および図鑑ページ生成の処理のため、写真データが一時的に外部サーバーに送信されますが、処理完了後に保持されることはありません
• お客様は、登録するコンテンツが第三者の権利を侵害しないことを保証するものとします

6. 広告

無料プランでは、Google AdMobによる広告が表示されます。Proプランに加入することで広告を非表示にできます。広告に関するデータの取り扱いについては、プライバシーポリシーをご確認ください。

7. 禁止事項

お客様は、以下の行為を行ってはなりません：

• 本アプリの不正利用、セキュリティ機能の回避
• AIサービスへの過剰なリクエスト送信やAPIの不正利用
• 本アプリを利用した違法行為
• 他のユーザーへの嫌がらせや妨害行為

8. 免責事項

• 本アプリは「現状のまま」提供され、明示・黙示を問わず、いかなる保証も行いません
• 本アプリの使用または使用不能から生じるいかなる損害についても、開発者は責任を負いません
• 開発者は、予告なく本アプリの機能を変更、停止、または終了する権利を有します
• 端末の故障、紛失等によるデータの消失について、開発者は責任を負いません

9. 準拠法

本規約は日本法に準拠し、日本法に従って解釈されるものとします。本規約に関連する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

10. 規約の変更

開発者は、本規約を随時変更する権利を有します。重要な変更がある場合は、アプリ内またはウェブサイトで通知します。変更後に本アプリを継続して使用することにより、変更後の規約に同意したものとみなされます。

11. Apple標準EULAの適用

本規約に定めのない事項については、Appleの標準使用許諾契約（Standard EULA）が適用されます。本規約とApple標準EULAの間に矛盾がある場合は、本規約が優先されます。

12. お問い合わせ

These Terms of Use (the "Terms") govern your use of the iOS application "Zukanly" (the "App") developed by Daiki Hayashi (the "Developer"). By downloading or using the App, you agree to be bound by these Terms.

1. License Grant

The Developer grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes, subject to the following restrictions:

• You may not copy, modify, reverse engineer, decompile, or disassemble the App
• You may not sell, rent, lease, or redistribute the App in whole or in part
• You may not use the App for any unlawful purpose

2. Service Description

The App is a nature observation field guide designed for recording and managing discoveries. It provides the following features:

• Photo-based registration and management of organisms
• AI-powered species identification (results are for reference only and accuracy is not guaranteed)
• AI-generated guide pages
• Map-based recording of discovery locations

3. AI Feature Disclaimer

The AI identification feature is a reference tool that estimates species from photographs. Please note the following:

• AI identification results are for reference only and are not guaranteed to be scientifically or medically accurate
• Do not rely solely on AI identification to determine whether organisms are toxic or dangerous
• Do not use AI identification results to determine edibility
• All actions taken based on AI identification results are at your own risk

4. Subscriptions

• The App provides basic features for free and offers a Pro plan (monthly/annual auto-renewing subscription) with additional features
• Subscriptions are charged to your Apple ID account
• Any unused portion of a free trial period will be forfeited upon purchasing a subscription
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Subscriptions can be managed and cancelled from your App Store account settings after purchase
• No pro-rata refunds are provided for mid-period cancellations

5. User Content

• You retain all intellectual property rights to photos, notes, and other content you register in the App
• Photo data is temporarily sent to external servers for AI identification and guide page generation, but is not retained after processing
• You warrant that the content you register does not infringe upon the rights of any third party

6. Advertising

The free plan displays advertisements served by Google AdMob. You can remove ads by subscribing to the Pro plan. For information on how advertising data is handled, please refer to our Privacy Policy.

7. Prohibited Activities

You agree not to:

• Misuse the App or circumvent its security features
• Send excessive requests to the AI service or misuse the API
• Use the App for any illegal activities
• Harass or interfere with other users

8. Disclaimer of Warranties

• The App is provided "as is" without warranties of any kind, express or implied
• The Developer shall not be liable for any damages arising from the use or inability to use the App
• The Developer reserves the right to modify, suspend, or discontinue the App at any time without notice
• The Developer is not responsible for data loss due to device failure, loss, or other causes

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

10. Changes to These Terms

The Developer reserves the right to modify these Terms at any time. If significant changes are made, users will be notified within the App or on the website. Continued use of the App after changes constitutes acceptance of the revised Terms.

11. Apple Standard EULA

For matters not covered by these Terms, Apple's Standard End User License Agreement (EULA) shall apply. In the event of any conflict between these Terms and Apple's Standard EULA, these Terms shall prevail.
